Terms of use

Terms for using Semper.

These terms cover the Semper app, website, and project-provided releases. They do not replace or narrow the rights granted by the applicable software licenses.

Acceptance

These Terms of Use govern your use of the Semper macOS app, the website at semper.systems, and project-provided release downloads. By accessing or using them, you agree to these terms. If you do not agree, do not use them.

Repository licensing information

Consult the repository's license file and notices for licensing information.

These terms do not replace, narrow, or add restrictions to rights granted by applicable software licenses. Third-party code and data remain subject to their own notices and licenses.

Use of Semper

You may use Semper only:

  • In compliance with applicable law.
  • On devices, apps, audio, and systems that you own or are authorized to control.
  • In accordance with applicable open-source and third-party licenses.

You may not use the website or project infrastructure to distribute malware, interfere with service operation, gain unauthorized access, violate another person's rights, or falsely claim affiliation with or endorsement by Semper or its maintainers.

Audio and system responsibility

Semper can change audio levels, route audio between devices, intercept media keys, connect paired Bluetooth devices, and apply software gain and EQ.

You are responsible for your settings and their effects. Start at a safe listening level. Excessive volume or gain can damage hearing, speakers, headphones, or other equipment. Test routing changes before calls, recordings, performances, broadcasts, or other situations where an interruption or incorrect output could cause harm or loss.

You decide which macOS permissions to grant. Features that require a permission may not work when it is denied or revoked.

Releases, previews, and availability

Semper is a project under active development. Features, compatibility, release files, website content, and update availability may change or be removed at any time. There is no promise of continuous operation, support, maintenance, a particular release schedule, or compatibility with every app or audio device.

Source builds and preview releases may be incomplete or unstable. Back up important settings and test before relying on Semper in a production, accessibility, safety, or time-sensitive setting.

Website and project identity

The website and project documentation are provided for general information. They may contain errors or become outdated. Technical descriptions do not guarantee that a feature will work with your hardware, operating system, or workflow.

Unless a separate license says otherwise, these terms do not grant rights to use the Semper name, logo, or other project branding beyond truthful reference to the project. Do not imply that a modified build, fork, or service is an official Semper release.

Contributions and community spaces

Contributions are governed by CONTRIBUTING.md, the repository's licensing notices, and the Code of Conduct. You must have the right to submit your contribution. Contributors retain copyright in their original work.

GitHub hosts the repository and community activity. Your use of GitHub is also subject to the GitHub Terms of Service.

Third-party services and materials

Semper can interact with or link to services and materials provided by Apple, GitHub, Vercel, Sparkle, AutoEq, hardware manufacturers, and other parties. Those parties control their own products, terms, privacy practices, availability, and content. Semper maintainers are not responsible for third-party services or materials.

AutoEQ profiles are derived from third-party measurement sources and are not medical advice or a guarantee of hearing safety, accuracy, or sound quality.

Privacy

The Semper Privacy Policy explains how the app, website, and maintainers handle information.

Disclaimer of warranties

To the fullest extent permitted by law, Semper, the website, release files, and project materials are provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and compatibility.

Nothing in these terms limits any warranty or right that applicable law does not allow to be excluded. Consult the applicable software licenses for their warranty terms.

Limitation of liability

To the fullest extent permitted by law, Semper's maintainers and contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, hearing, equipment, profits, goodwill, or business interruption arising from or related to Semper, the website, or project materials.

Where liability cannot be excluded, it is limited to the minimum amount permitted by applicable law.

Changes and access

These terms may be updated as the project changes. The date at the top will be updated, and material changes will be noted in the repository. Continued use after a change takes effect means you accept the revised terms.

Maintainers may restrict access to project-controlled website or community spaces for misuse, security risk, or Code of Conduct violations. This does not cancel rights already granted under an applicable open-source license for copies of the software you already received.

General terms and contact

If a provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These terms, the Privacy Policy, and the applicable software licenses form the agreement for the subjects they cover.

Applicable law governs rights that cannot be addressed by these terms. Nothing here limits consumer rights that cannot lawfully be waived.

The terms are versioned with the code. Read or propose changes on GitHub.
