1. Agreement
By using the Semper website, joining the waitlist, or using a Semper preview build, you agree to these Terms. If you do not agree, do not use the site or app.
2. Semper is pre-release
Semper is currently in development. Features may change, break, be delayed, or be removed. Early access does not guarantee availability, support, compatibility, or a final public release date.
3. Your responsibilities
You agree not to:
- Use Semper for unlawful, harmful, or abusive activity.
- Attempt to interfere with, overload, or compromise the website or waitlist.
- Submit someone else’s email without permission.
- Use Semper to capture information you are not allowed to access or retain.
4. Local capture and sensitive content
Semper is designed to help you remember your own workflow. You are responsible for how you configure and use any capture features, including whether captures may include sensitive, confidential, personal, school, employer, client, or third-party content.
5. Privacy
The Privacy Policy explains what the site currently collects and how Semper is being designed around local-first app data.
6. Intellectual property
The Semper name, website, design, and non-open-source materials are owned by Semper or its creators. When Semper releases source code, that code will be governed by the license included with the source release.
7. Feedback
If you send ideas, bug reports, suggestions, or other feedback, you allow Semper to use that feedback without restriction or compensation, while you keep ownership of your own underlying rights in the feedback.
8. Third-party services
The site or future app may link to or integrate with third-party services. Semper is not responsible for third-party services, terms, privacy practices, or availability.
9. Disclaimers
The site, waitlist, and any pre-release app are provided “as is” and “as available.” To the fullest extent permitted by law, Semper disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by law, Semper will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or business interruption arising from your use of the site, waitlist, or preview app.
11. Termination
We may suspend or discontinue access to the site, waitlist, or preview builds at any time, including if we believe these Terms have been violated.
12. Governing law
These Terms are intended to be governed by the laws of California, excluding conflict of law rules, unless applicable law requires otherwise.
